TERMS AND CONDITIONS OF USE OF WEBSITE

PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY AS THEY CONTAIN IMPORTANT INFORMATION REGARDING YOUR LEGAL RIGHTS, REMEDIES AND OBLIGATIONS. THESE INCLUDE VARIOUS LIMITATIONS AND EXCLUSIONS, AND A CLAUSE THAT GOVERNS THE JURISDICTION AND VENUE OF DISPUTES.
BIBTECH SDN BHD, Brand Name represented by “BIBIT”, incorporated in Malaysia as a Private Limited company with the registration number (1245159-A) operates a web-based platform that connects requesters (local) who wants to purchase items overseas with travellers (either local or foreign) who are travelling to overseas countries and are willing to make purchases on behalf of the requester for delivery back to Malaysia. The services provided by BIBIT, are accessible through our website at www.bibit.com.my, and any future mobile applications, services or products. By using the Site, you agree to comply with and be legally bound by the terms and conditions of these Terms of Service (“Terms“), whether or not you become a registered user of the Services.
KEY TERMS
“The Site” refers to the website platform operated by BIBTECH SDN BHD under the domain name https://www.bibit.com.my, which include all the technology and services offered by the website.
The terms “BIBIT”, “we”, “us”, and “our” refer to the management team of BIBTECH SDN BHD.
The terms “user”, “Members”, “you”, “your” refer to the site visitors, customers and any other users of the site.
“Content” means text, graphics, images, music, software (excluding the Application), audio, video, information or other materials.
“Requester” means a Member who posts requests for an product (overseas or local) on the Site and contacts another Member on the site who is a Traveller to assist in purchasing and delivering the product for a particular price as agreed upon between respective requester and traveller. A requester also refers to Member who places orders from the Purchase Recommendations by the traveller. A requester willingly enters into the transaction with the traveller, and exempts BIBIT from any liability, mistakes, violation of trusts, and counterfeit actions that may possibly arise from dealing with travellers.
“Traveller” means a Member who creates a Trip of his or her travel plans and consents that upon making an offer to the requester and with the offer accepted, the traveller agrees to purchase and transport the product to the respective requester, either by direct postage and via an drop off point (BIBIT office) as agreed in their transaction on the Site. A traveller willingly enters into the transaction, assumes full responsibility of transporting the products for the requester, and exempts BIBIT from any liability, infringements on customs regulations such as declaration of Taxes and bringing in of prohibited items. The traveller also exempts BIBIT from any liability, mistakes, violation of trusts, and counterfeit actions that may possibly arise from dealing with requesters.
“Deal”, “Transaction”, “Request Order” means an agreement between a Requester and a Traveller regarding a requested product and the details of the agreement.
ACKNOWLEDGEMENT AND ACCEPTANCE OF AGREEMENT
By using the Site, you agree to the Terms and Conditions that are listed in this article as well as consenting to the Privacy Policy. These two articles can be found on www.bibit.com.my and we do not take responsibility for any user negligence in not reading the Terms and Conditions/Privacy Policy before using the Site.
YOU ACKNOWLEDGE AND AGREE THAT, BY ACCESSING OR USING THE SITE, APPLICATION OR SERVICES OR BY DOWNLOADING OR POSTING ANY CONTENT FROM OR ON THE SITE. YOU ARE INDICATING THAT YOU HAVE READ, UNDERSTAND AND AGREE TO BE BOUND BY THESE TERMS, WHETHER OR NOT YOU HAVE REGISTERED WITH THE SITE AND APPLICATION. IF YOU DO NOT AGREE TO THESE TERMS, THEN YOU HAVE NO RIGHT TO ACCESS OR USE THE SITE, APPLICATION, SERVICES, OR COLLECTIVE CONTENT.
DESCRIPTION OF BIBIT AND THE SITE
BIBIT is an online peer-to-peer platform that connects users (acting as either Requester or Traveller) to interact within our web-based platform. We provide all the necessary services and online tools for these users to perform transactions on the Site. BIBIT is not an online seller or retailer, broker or agent for reselling products including but not limited to products marketed by third party companies, brands, or government agencies. BIBIT’s role remains to provide a service for users to connect and arrange transactions on our platform.
PLEASE NOTE THAT, BIBIT CANNOT AND DOES NOT CONTROL ANY CONTENT OR TRANSACTIONS CREATED ON OUR PLATFORM INVOLVING THE CONDITION, LEGALITY AND SUITABILITY FOR THESE NATURE. ANY LIABILITY RELATED TO CONTENT AND TRANSACTIONS IS NOT UNDER THE RESPONSIBILITY OF BIBIT AND AS SUCH THE USE OF THE SITE (WITH RESPECT TO CONTENT AND TRANSACTIONS) WILL BE UNDER THE MEMBER’S OWN RISK.
BIBIT ACCOUNT AND USER INFORMATION
We require all Member’s to provide accurate information with respect to the details of your BIBIT user account. However we do not attempt to make any confirmation to any Member’s purported identity and account details. You are responsible for any information provided to BIBIT and any damage or harm resulting from the use of the Site and interaction with other Members is of your own risk.
If you suspect that your account has been hacked and misused, please contact BIBIT at support@bibit.com.my for our action.
MODIFICATION OF USER ACCOUNT DETAILS, TRANSACTION DETAILS, CONTENT
BIBIT reserves the full right and at its sole discretion, to modify the Site and any data/details provided to us by you, including any account details, personal information, transaction details, user content, at any time without prior notice. For any modification of Terms and Conditions/Privacy Policy, please refer to the “Latest Updated Date” on the respective articles. We expect all users to be full updated on any modifications and agree to any changes should you proceed to continue using the Site.
TRANSACTION BETWEEN REQUESTER AND TRAVELLER
By entering into a transaction with another Member of the Site, users understand and agree that you are responsible for any laws, rules and regulations that may apply for going into such transaction. We are not responsible for any loss, damage, or legal bindings should the Member encounter such problems. However we are available to remedy any disagreements/disputes that may arise from entering into such transaction, and we are contactable at support@bibit.com.my.
Requester Payment Terms
After a Requester has accepted an offer from a Traveller and has proceeded to complete the deposit payment for the request, BIBIT will store/use all information entered to process the payment through our partner banks. By making those payments, you are providing us with consent for us to pass the aforementioned details to our partner banks to perform a monetary transaction on your bank account.
Traveller Release of Payment Terms
Following the completion of your request (subject to delivery and approval from requester), BIBIT will make the monetary deposit reimbursement to Travellers using our respective banking partner, under our sole discretion to use whichever banking partner we currently have.
BIBIT has a payment policy that we will make reimbursements to the Travellers after 7 days of Traveller delivering the product (See Shipping Policy). After 7 days, should there be no disputes brought up by the Requester, or regardless of acknowledgement from the Requester, we will proceed to release the payment to the Traveller.
USER CONDUCT RULES AND REGULATIONS
You understand and agree to comply with the rules and regulations set out on BIBIT with regard to User Conduct during the use of the Site. These rules and regulations prohibits the user:
  • avoid, bypass, remove, deactivate, impair, descramble, or otherwise circumvent any technological measure implemented by BIBIT or any of BIBIT’s providers or any other third party (including another user) to protect the Site, Services or Content;
  • abuse the referral system by creating multiple fake accounts to complete multiple transactions;
  • violate any local, state, provincial, national, or other law or regulation, or any order of a court, including, without limitation, zoning restrictions and Tax regulations;
  • use manual or automated software, devices, scripts robots, other means or processes to access, “scrape,” “crawl” or “spider” any web pages or other services contained in the Site, Services or Content;
  • use the Site, Services or Content for any commercial or other purposes that are not expressly permitted by these Terms;
  • copy, store or otherwise access any information contained on the Site, Services or Content for purposes not expressly permitted by these Terms;
  • infringe the rights of any person or entity, including without limitation, their intellectual property, privacy, publicity or contractual rights;
  • interfere with or damage our Site, including, without limitation, through the use of viruses, cancel bots, Trojan horses, harmful code, flood pings, denial-of-service attacks, packet or IP spoofing, forged routing or electronic mail address information or similar methods or technology;
  • use our Site, Services or Content to transmit, distribute, post or submit any information concerning any other person or entity, including without limitation, photographs of others without their permission, personal contact information or credit, debit, calling card or account numbers;
  • use our Site, Services or Content in connection with the distribution of unsolicited commercial email (“spam”) or advertisements unrelated to lodging in a private residence;
  • “stalk” or harass any other user of our Site, Services or Content or collect or store any personally identifiable information about any other user other than for purposes of transacting as an BIBIT Traveller and Requester;
  • contact a Requester for any purpose other than asking a question related to a Deal, such as asking marketing items to the Requester for items not stated on the Site;
  • contact a Traveller for any purpose other than asking a question related to a Deal such as asking the Traveller to carry other stuff not stated in the transaction;
  • when acting as a visitor or otherwise, recruit or otherwise solicit any Member to join third party services or websites that are competitive to BIBIT, without BIBIT’s prior written approval;
  • impersonate any person or entity, or falsify or otherwise misrepresent yourself or your affiliation with any person or entity;
  • use automated scripts to collect information or otherwise interact with the Site, Services or Content ; use the Site, to find a Requester or Traveller and then complete a booking of a Deal transaction independent of the Site, in order to circumvent the obligation to pay any Service Fees related to BIBIT’s provision of the Services;
  • as a Traveller, submit any Listing with a false or misleading price information, or submit any Listing with a price that you do not intend to honor;
  • or post, upload, publish, submit or transmit any Content that: (i) infringes, misappropriates or violates any Malaysia Law. Such as a third party’s patent, copyright, trademark, trade secret, moral rights or other intellectual property rights, or rights of publicity or privacy; (ii) violates, or encourages any conduct that would violate, any applicable law or regulation or would give rise to civil liability; (iii) is fraudulent, false, misleading or deceptive; (iv) is defamatory, obscene, pornographic, vulgar or offensive; (v) promotes discrimination, bigotry, racism, hatred, harassment or harm against any individual or group; (vi) is violent or threatening or promotes violence or actions that are threatening to any other person; or (vii) promotes illegal or harmful activities or substances;
  • systematically retrieve data or other content from our Site, to create or compile, directly or indirectly, in single or multiple downloads, a collection, compilation, database, directory or the like, whether by manual methods, through the use of bots, crawlers, or spiders, or otherwise;
  • use, display, mirror or frame the Site, or any individual element within the Site or Services, BIBIT’s name, any BIBIT trademark, logo or other proprietary information, or the layout and design of any page or form contained on a page, without BIBIT’s express written consent;
  • access, tamper with, or use non-public areas of the Site or Application, BIBIT’s computer systems, or the technical delivery systems of BIBIT’s providers;
  • attempt to probe, scan, or test the vulnerability of any BIBIT system or network or breach any security or authentication measures;
  • attempt to decipher, decompile, disassemble or reverse engineer any of the software used to provide the Site, Services, Application or Collective Content; or advocate, encourage, or assist any third party in doing any of the foregoing.
  • hold BIBIT responsible for any refund for perishable food that are found to be unfit for consumption if these products are not collected within 48 hours of a Traveller delivery.
BIBIT will have the right to investigate, ban and remove any Content that is in violation of any of the above to the fullest extent of the law. BIBIT may take action and report your action to law enforcement authorities to prosecute users who have violated these Terms. You acknowledge that BIBIT has no obligation to monitor your access to or use of the Site, Services or Content, but has the right to do so for the purpose of operating the Site. BIBIT reserves the right, at any time and without prior notice, to remove or disable access to any content or user account that BIBIT, at its sole discretion, considers to be in violation of these Terms or otherwise represents to be harmful to the Site.
SHIPPING POLICY FOR REQUESTER/TRAVELLER
Pick-up/Drop Off Option
This option is free of charge for both requester/traveller. All Members are welcomed to proceed to our office to pick up/drop off your items at:

47500 Subang Jaya, Selangor Darul Ehsan
For Travellers who opt to drop off items at our office but are unable to do so in person, you may deliver those items by postage to our address above. We will acknowledge the items delivered to our office and will inform the requesters on the arrival of such items. Should travellers decide to post items to our office (which is still considered drop off), we will only acknowledge that the traveller has delivered the items once it has reached our office.
BIBIT will release the deposit payment to the traveller if the item remains uncollected 7 days after the traveller delivers. BIBIT will not attend to any disputes in relation to the item beyond this 7-day collection window, as payment has been released.
Direct Postage/Courier Option
Requester may opt for your traveller to post your item as an option, or should it be requested by the traveller. The postage cost will be determined by both parties based on total weight of the items, quantity of items, and size of the item.
Should you decide to switch to courier delivery after selecting self-pick up upon checkout, we can manually arrange the courier delivery for you at a cost. The postage cost is determined based on total weight of the products. Changes of delivery method to self-collect after selecting courier delivery is not allowed after order has been successfully made, confirmed and deposit has been paid.
HANDLING OF ITEMS RECEIVED IN OFFICE
Disposal of uncollected items
If the item remains uncollected 14 days after the traveller delivers, BIBIT will dispose the item accordingly. If the requester requires a period of time longer than 14 days, please contact us at support@bibit.com.my.
Perishable goods
Requesters may put up a request for perishable food products with short shelf-lives, or that require special handling (i.e. refrigeration or freezing), but do so at their own risk. BIBIT will not compensate requesters in the event these food products become unfit for consumption. Also, to ensure the safety of requesters, BIBIT may dispose uncollected expired or inconsumable food items.
CANCELLATION, DISPUTES, REFUNDS AND RETURNS POLICY
Changing Of Details After Placing Deposit
If price changes is required after deposit has been paid, the traveller will have to email us at support@bibit.com.my to notify us or such changes to the request order. The price changes can only take place after discussion has taken place between both requester and traveller with subsequent agreement from both parties.
There will be two scenarios to proceed with:
  1. For deposit top-ups, the traveller will be required to make a new offer on the request order for the DIFFERENCE IN INITIAL PRICE and the NEW PRICE. The requester will have to accept and make a new payment via the same mode of payment as your first deposit. We will manually acknowledge the initial deposit plus the new “top-up” deposit.
  2. For deposit partial refunds, we will change the price offered on the request order for the new price. Your refund will be processed within 48 hours and will be credited to the requester account within 5 to 15 business days, depending on your payment method, bank and/or financial institution.
Changes in delivery address / phone number / recipient of the item is not allowed after order has been successfully made. This is one of the precaution steps to avoid fraud attempt. Kindly ensure all of the information is correct prior placing an order.
CANCELLATION OF ORDERS
Cancellation by requester
Requesters may cancel the deal if the status of the request is “Open” or “Accepted”
In order to protect the traveller from last minute transactions, requester will not be able to cancel the transaction after deposits has been paid unless it is agreed by the traveller.
Cancellation is free of charge and we do not incur any cancellation fees. However, BIBIT cannot reverse a cancellation once it is completed. We cannot restore your order after the order has been cancelled. For cancellations, although we do not charge any cancellation fee, please note that there may be a banking charge for perform the refund of the deposit.
Cancellation by traveller
Travellers may cancel the deal if the status of the request is “Open”, “Accepted”
When “Cancel Offer” is clicked, a pop-up menu will appear where you will be prompted for the reason for the cancellation. Please note that cancelling a request will affect your delivery completion rate and rating on the Site. We expect all travellers to fulfil their delivery once they have made their offers to the Requester as any cancellation will disrupt the Requester chance to purchase the item overseas.
Travellers are permitted 10 cancellations per month. Upon hitting the cancellation limit, travellers are temporarily suspended from making new offers or commenting on “Open” requests. The cancellation limit will be reset and suspension lifted on the first day of the following month.
DISPUTES, REFUNDS AND RETURNS
Requester will receive full refund if:
  • there is no response from the traveller within 7 days of the proposed delivery date of the traveller
  • wrong item has been purchased by the travellers and the item is returned to the travellers
  • fake or counterfeit item has been purchased by the travellers and the goods is returned to the travellers. BIBIT does not possess the expertise in ascertaining the authenticity of products, onus is on the requester to seek the assessment of a qualified 3rd-party (e.g. authorized dealer). Such claims will be handled on a case-by-case basis and should there be sufficient evidence to suggest that the item purchased by the traveller is not authentic, BIBIT can proceed with a full refund. The item will subsequently be returned to the traveller.
Requesters will receive full or partial refund if :
  • item received from the traveller is badly damaged. In the event of full refund, item will be returned to the travellers. The degree of damage warranting a full refund will be determined at BIBIT’s discretion. Minor imperfections that do not affect the functionality of the item will not warrant a refund, unless agreed upon by the traveller.
  • portion of the request is not purchased by the travellers
All refund will be processed within 48 hours when the cancellation request is successful. However, the refund amount will be the net amount paid by the requester including the banking charges for performing the refund. The refund will be credited to the requester’s account within 5 to 15 business days, depending on payment method, bank and/or financial institution.
By accepting and bringing the items out of our office, requesters and/or their proxies agree that the service rendered by BIBIT was satisfactory. BIBIT will not be able to assist in the case of a dispute if the requested-for item was accepted and collected, or if payment has been released to the traveller after the 7-day self-collection window.
For items sent via courier service, any disputes regarding damage have to be raised directly with BIBIT within 7 days of delivery by the traveller. BIBIT will release payment to the traveller after this 7-day period and once payment is released, BIBIT will not be able to assist in the case of a dispute.
PROCEDURES FOR ITEMS RETURNED
In the event should any dispute for any transaction arise, a report must first be made with BIBIT first by emailing us at support@bibit.com.my. We will access the report, analyse the situation for the dispute and mediate the discussion between both requester and traveller. In the event that we agree for the requester to reject the item and proceed with full refund, the following steps will take place:
  1. The requester must return the items to the BIBIT office (address can be found at the About Us section). Costs for postage or delivery of such item will be borne by the requester.
  2. BIBIT bears no responsibility for items lost in transit, therefore we advise that the requester drop off the item in person. If the requester is unable to deliver the item, we suggest that a trackable postal or courier service to be used for returns. Regardless at this point, the responsibility still lies with the requester and the delivery company you have used.
  3. Once we have received the returned item, we will conduct a full inspection of the item, to determine the condition, quantity of item and usability before ascertaining whether a refund or exchange may be made. If the returned item has been opened, shows signs of obvious use, has been damaged whilst in the requester’s possession, is not in its original state or condition, and/or is missing parts, the return claim will be rejected.
  4. BIBIT will return the items to the traveller and then proceed with the refund process for the requester.
CURRENCY CONVERSION, REFUND AND PAYMENT
All currency conversion for overseas item denoted in foreign currency will be the responsibility of the Members. The Site will only process transactions that are denoted in Malaysia Ringgit (MYR or RM). We advise all Members to only denote any request orders or purchase recommendations in Malaysia Ringgit.
BIBIT will not entertain any disputes, refunds or payment relating to currency conversion error when transacting on the Site.
WARRANTY, LIABILITY AND DISCLAIMERS
BIBIT DO NOT AND WILL NEVER OFFER ANY FORM OF WARRANTY, LIABILITY OR DISCLAIMER PROTECTION FOR ANY TRANSACTION PERFORMED ON THE SITE. THIS APPLIES TO ANY WARRANTY CLAIM FOR THE ITEMS THAT IS TRANSACTED BETWEEN THE MEMBERS OF THE SITE. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED FROM BIBIT OR THROUGH THE SITE, APPLICATION, SERVICES OR COLLECTIVE CONTENT, WILL CREATE ANY WARRANTY NOT EXPRESSLY MADE HEREIN.
YOU ARE SOLELY RESPONSIBLE FOR ALL OF YOUR COMMUNICATIONS AND INTERACTIONS WITH OTHER USERS OF THE SITE, AND WITH OTHER PERSONS WITH WHOM YOU COMMUNICATE OR INTERACT AS A RESULT OF YOUR USE OF THE SITE, INCLUDING, BUT NOT LIMITED TO, ANY TRAVELLER AND REQUESTER.
YOU AGREE TO TAKE REASONABLE PRECAUTIONS IN ALL COMMUNICATIONS AND INTERACTIONS WITH OTHER USERS OF THE SITE, AND WITH OTHER PERSONS WITH WHOM YOU COMMUNICATE OR INTERACT AS A RESULT OF YOUR USE OF THE SITE, INCLUDING, BUT NOT LIMITED TO, TRAVELLER AND REQUESTER, PARTICULARLY IF YOU DECIDE TO MEET OFFLINE OR IN PERSON REGARDLESS OF WHETHER SUCH MEETINGS ARE ORGANIZED BY BIBIT.
LAWS, REGULATIONS, CUSTOM DUTIES AND PROHIBITED ITEMS
GST DECLARATIONS
Under the provision of the Customs Act 1967, travellers entering Malaysia are required to declare all dutiable or prohibited goods in their possession. Failure to declare dutiable or prohibited goods or making false declaration is an offence.
Travellers who visit Malaysia for a period of not less than 72 hours are eligible for specified amount of customs duties exemption.
DUTIABLE GOODS
Subject to Customs Duties Order, travellers should pay only a customs duty at a flatrate of 30% ad valorem. In the case of alcoholic beverages, tyres, spirits, tobacco, cigarettes and motor vehicles, the rate of duty will be based on prevailing Customs Duties Order.
DUTY EXEMPTION PER TRAVELLER
Travellers Exempted: Residents & Non-residents
Conditions:
  • Non residents having intention to visit Malaysia for not less than 72 hours.
  • Residents returning after an absence from Malaysia of not less than 72 hours (for Labuan is 24 hours and for Langkawi or Pulau Tioman is 48 hours)
Goods Exempted:
  • Wine/spirit/malt/liquor not exceeding 1 liter.
  • Tobacco not exceeding 225 grams (equal to 200 sticks of cigarettes).
  • New wearing apparels up to 3 pieces.
  • 1 pair of new footwear.
  • Portable electrical or battery operated appliances for personal care and hygiene not exceeding 1 unit each.
  • Foods preparations up to total value of not exceeding RM75.
  • All other goods including gifts and souvenirs other than alcoholic beverages, spirits, tyres, tubes, tobacco, cigarettes and motor vehicles, valued not exceeding RM400 ( goods from Langkawi, Pulau Tioman and Labuan, not exceeding RM500).
If the travellers bring in excess quantity of goods exempted, he shall be liable to duty on the excess only.
GREEN/RED LANE FACILITIES
Green Lane is for travellers with “Nothing to Declare” (non-dutiable and non-prohibited goods). Otherwise the travellers have to proceed to the Red Lane and declare the goods.
